Terms and Conditions

1. Scope
These General Terms and Conditions (GTC) apply to all contracts between
(hereinafter "Seller") and consumers within the meaning of § 13 BGB or entrepreneurs within the meaning of § 14 BGB (hereinafter "Buyer"), which are concluded via the online shop on www.yawn-labs.com. Deviating conditions of the buyer are not recognized unless the seller expressly agrees to them in writing.
2. Conclusion of Contract
The product presentations in the online shop do not constitute a legally binding offer, but an invitation to submit an offer (invitatio ad offerendum).
By clicking the "Proceed to Checkout" button and then completing the payment process, the buyer submits a binding offer to purchase the selected product. The seller confirms receipt of the order by e-mail (confirmation of receipt). The acceptance of the offer - and thus the conclusion of the purchase contract - takes place through a separate order confirmation by e-mail or by dispatch of the goods.
3. Prices and Taxes
All prices are final prices in Euro.
According to § 19 UStG, no sales tax is charged or shown. All prices are gross prices plus shipping costs.

4. Payment Conditions
Payment is made via the payment service provider Mollie (Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands). The following payment methods are available depending on the country:
- Credit card (Visa, Mastercard)
- SEPA Direct Debit
- Other methods according to Mollie checkout
The purchase price is due immediately upon conclusion of the order. The goods will only be dispatched after receipt of payment.
5. Delivery
The seller delivers to the following countries: Germany, Austria, Switzerland and other European countries as specified in the ordering process.
The delivery time is up to 7 working days from receipt of payment. For individually manufactured products, the delivery time can be up to 2 weeks. The seller informs the buyer by e-mail about the dispatch.
The risk of accidental loss and accidental deterioration of the goods shall pass to the buyer upon delivery to the buyer or to a person designated by the buyer.
6. Retention of Title
The delivered goods remain the property of the seller until full payment of the purchase price.
7. Right of Revocation
Consumers are generally entitled to a statutory right of revocation. You can find the detailed revocation policy and information on the exception for individually manufactured products on the page Revocation Policy.
8. Warranty for Defects
The statutory warranty for defects shall apply. In the case of used goods, the liability period may be shortened to one year; this shall not apply to damages resulting from injury to life, body or health or from an intentional or grossly negligent breach of duty by the seller.
9. Limitation of Liability
The seller is liable without limitation for damages caused by injury to life, body or health, as well as for damages caused intentionally or by gross negligence. For property damage caused by slight negligence, the seller is only liable in the event of a breach of an essential contractual obligation, but limited to the foreseeable, contract-typical damage.
10. Dispute Resolution

We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Applicable Law and Place of Jurisdiction
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In addition, the mandatory consumer law of the buyer's country of residence shall apply to consumers within the EU.
The place of jurisdiction for buyers who do not have a general place of jurisdiction in Germany or who have moved their residence abroad after conclusion of the contract is the registered office of the seller.
